I know there are rules for playing them in Transhuman but my question is do you need to choose a specific background or take a merit to be one? Or do you just say hey instead of Transhuman I am an AGI?

There is an Infolife
There is an Infolife background in the core book, as well as a few more specific Infolife backgrounds in Transhuman. By taking one of them, your character is an AGI.

I wouldn't ding you if you wanted to pick an AGI or Uplift. I would even allow you to choose one background and then tack on Social Stigma (AGI) if you wanted to be an AGI that had that background. Come up with a half believable reason for your background and why you have it despite not being a human. I don't see a problem with it since most backgrounds are worth 40 cp. Those backgrounds that offer more tend to have drawbacks to pay for them.
I could even be convinced into allowing a player to play an Alien, but I would need a good reason why that would fit the story/campaign. Alien PCs are not allowed by cannon.

But
AGI ARE Transhumans. The "trans-" part is there not just because humans are more than humans… humanity is encompassing the beings made in their image. The "proper" AGI background has some restrictions if you want to really role-play it, but a sane GM will let you be whatever, because we're all Transhuman here.
